1. Who we are

Deembyte LLC is a software development agency registered in the State of Wyoming. When this policy says "Deembyte," "we," "us," or "our," it means the company operating the website at deembyte.com.

We act as the data controller for personal data collected through this website. Questions about this policy or how we handle your data can be directed to [email protected].

2. What we collect

We collect only what is necessary to provide the services you request or to operate the Site securely.

Contact form submissions

When you submit an inquiry through our contact form, we collect: your name, email address, phone number (optional), company name (optional), the service you are interested in, an indication of your project budget, and your message.

AI chat assistant

When you use the AI chat assistant on the Site, we collect: the messages you send during the conversation, and, if you choose to provide them, your name and email address so we can follow up. Conversation history is stored server-side to maintain continuity within a session. We recommend that you do not share sensitive personal information, financial data, health information, or confidential third-party data through Chat.

Email correspondence

Any information you share when you email us directly at [email protected].

Purchases of Image Tools

When you buy Image Tools we collect your email address and a record of the order: the amount paid, the date, the Stripe checkout and payment references, the order status (pending, paid or refunded), a private download token, and the number of times your download links have been used. We also keep a record that you accepted the Terms of Service and Refund Policy at checkout, which version you accepted, when, and, where you gave it, your confirmation that your download should start immediately. Your card details are entered on Stripe's own checkout page and never reach our servers.

The Image Tools app

The Image Tools app runs on your computer. It has no accounts and no telemetry, works offline, and does not send your images, file names or usage to us or to anyone else. This policy therefore covers this Site and your purchase, not the operation of the app.

Technical data

We may collect your IP address and session identifiers for security purposes, to prevent abuse, and to maintain service reliability. We may also collect standard server log data such as pages visited and referrer URLs.

3. How we collect it

We collect information you provide directly, through the contact form, the AI chat assistant, or by emailing us. We also collect certain technical data automatically as a standard part of operating a web service, such as IP addresses recorded in server logs. Purchase data comes from you at checkout and from Stripe, which tells us when a payment has been completed or refunded.

4. How we use it

• To read and respond to your inquiry.
• To scope, price, and deliver the project you engage us for.
• To route your project inquiry to our engineering team when submitted via Chat.
• To maintain the security and integrity of the Site and prevent misuse.
• To understand which pages and features are useful so we can improve them.
• To take payment, deliver your downloads, and send your purchase confirmation.
• To process refunds, answer support requests about a purchase, and keep the financial records the law requires.
• To prevent fraud and abuse of the download service, for example by counting downloads per purchase.

We will not send you marketing emails unless you have explicitly asked us to keep you informed. Your purchase confirmation is a transactional message, and we do not add your purchase email address to any marketing list. We do not use your data for automated decision-making that produces legal or similarly significant effects on you.

5. Why we process your data

We process your personal data for the following reasons:

• Legitimate interests: responding to a business inquiry you initiated, operating Chat, maintaining site security, preventing fraud and abuse, and improving the Site, where those interests are not overridden by your rights.
• Contract performance: processing data necessary to deliver a project you have engaged us for, or to complete and fulfil a purchase from our store, including refunds.
• Consent: where we ask before sending any optional communication.
• Legal obligation: where we are required to retain or disclose data by applicable law, for example tax and accounting records of a sale.

6. AI features and automated processing

The AI chat assistant on this Site processes your messages using a third-party AI service provider. Your conversation messages are transmitted to that provider to generate responses. We have data processing arrangements in place with that provider to protect your data.

AI-generated responses are automated and may be inaccurate, incomplete, or outdated. They do not constitute professional advice. No AI system on this Site makes binding decisions about you.

We do not use Chat conversations for any purpose beyond operating the chat service, and we do not sell Chat data to third parties.

7. How we share it

We do not sell, rent, or share your personal data with third parties for their own purposes. We may share data with the following categories of service provider, solely to operate the Site and deliver our services:

• Cloud hosting providers: to store and serve the Site and its data.
• AI service provider: to process messages sent through the Chat feature.
• Email service provider: to send and receive business correspondence, including purchase confirmations, on our behalf.
• Payment processor (Stripe): takes your payment on its own hosted checkout page. Stripe receives your email address, your payment details and related transaction data. It processes them on our behalf and, for its own fraud prevention and legal compliance, as an independent controller. See Stripe's privacy policy.

Each provider is engaged under a contract that requires them to protect your data to at least the standard required by applicable law. We may also disclose data where required by law, court order, or to protect the rights, property, or safety of Deembyte or others.

8. Cookies and similar technologies

The Site uses only cookies that are strictly necessary for it to function. No advertising or tracking cookies are set on this Site. You can disable cookies in your browser settings; this may affect certain Site functionality. When you pay, you leave this Site for Stripe's hosted checkout page, which sets its own cookies for security and fraud prevention under Stripe's own policies.

9. International data transfers

We engage hosting and infrastructure providers that may process data in the United States or other countries. The AI service provider that powers Chat, and Stripe, may also process data outside the United States. Where personal data is transferred internationally, we take steps to ensure that appropriate safeguards are in place in accordance with applicable law.

10. Data retention

We retain contact form submissions, chat-originated inquiries, and related correspondence for no longer than two years from the date of submission, unless a longer period is required to fulfil a contract or comply with a legal obligation. Chat conversations that do not result in a submitted inquiry are deleted after a short period. Technical log data, including IP addresses, is retained for a shorter period for security purposes.

Purchase records (your email address, the order details, the payment reference and your acceptance of the Terms) are kept for seven years from the purchase, because tax and accounting rules require us to keep financial records. After that we delete them or remove the personal details. Download links stop working when a purchase is refunded.

You may request deletion of your data at any time; see Section 12.

11. Data security

We take reasonable technical and organisational measures to protect personal data against unauthorised access, loss, or disclosure. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security and accept no liability for unauthorised access beyond what is attributable to our failure to take reasonable precautions.

12. Your rights

Under applicable U.S. privacy laws, you have the right to:

• Access: request a copy of the personal data we hold about you.
• Rectification: request correction of inaccurate or incomplete data.
• Erasure: request deletion of your data, subject to legal retention obligations.
• Restriction: request that we limit how we process your data.
• Objection: object to processing based on legitimate interests.
• Portability: request a machine-readable copy of data you provided to us.
• Withdraw consent: where processing is based on consent, withdraw it at any time.

13. Children's privacy

The Site is intended for use by individuals aged 18 or over. We do not knowingly collect personal data from anyone under the age of 18. If you believe a minor has submitted data to us, please contact us at [email protected] and we will delete it promptly.

14. Third-party services

The Site may contain links to third-party websites or reference external services. This policy applies only to data collected by Deembyte through this Site. We are not responsible for the privacy practices of any third-party website or service. We encourage you to review the privacy policies of any third-party sites you visit. Stripe's own privacy policy governs the data it collects directly from you on its checkout page.

15. Changes to this policy

If we materially change how we handle personal data, we will update this page and revise the "Last updated" date above. Continued use of the Site after a change constitutes acceptance of the revised policy. For significant changes, we may take additional steps to notify you where we hold your contact details.
